The petitioner apprehends arrest in Fatehpur P.S. Case No. 68 of 2013 dated 04.03.2013 instituted under Sections 364/456/34 of the Indian Penal Code. As per the allegation, the petitioner along with two others is said to have a role in kidnapping of the husband of the informant.
Learned counsel for the petitioner submits that the informant and husband are neighbours and the past enmity is also admitted in the F.I.R. itself. It is stated that the story is unbelievable since the husband of the informant has returned and there is no explanation as to why when he was forcibly taken away by unknown persons on a motorcycle, no report was given to the police for one full day. It is submitted that the petitioner has no criminal antecedent.

opposes the prayer for anticipatory bail.
Considering the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the court below within six weeks from today, the petitioner be released on bail upon furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Gaya in Fatehpur P.S. Case No. 68 of 2013, subject to the conditions laid down in Section 438(2) of the Code of Criminal Procedure, 1973.
