2. The petitioners seek bail in a case registered for the offence punishable under Sections 406, 420 and 34 of the Indian Penal Code.
3. As per prosecution case, it is alleged that these petitioners, along with other accused persons, committed theft of truck of informant and sold it after changing its colour and structure.
4. It is submitted by learned counsel for the petitioners that petitioners are quite innocent and have committed no offence. Petitioners are not named in the F.I.R.. Name of
Patna High Court CR. MISC. No.24470 of 2025(2) dt.27-06-2025 2/2 petitioners transpired during course of investigation on the basis of confessional statement of co-accused co-accused Chhotu Kumar @ Chhotu @ Rahul @ Rahul Kumar who has already been granted bail by this Hon'ble Court vide order dated 06.12.2024 passed in Cr. Misc. No. 40385 of 2024. Petitioners are in custody since 19.09.2024.
5. On the other hand, learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioners and submitted that petitioners have 11 criminal antecedents of similar nature.
6. Considering the nature of accusation and fact that petitioners have got 11 criminal antecedents of similar nature, the prayer for grant bail of to the petitioners is rejected. (Prabhat Kumar Singh, J) shashank/- U T
