Petitioner apprehends his arrest in connection with Raghopur P.S. Case No. 75 of 2016 registered for the offences punishable under Sections-307, 379 & other minor sections of the Indian Penal Code.

Allegedly, the petitioner and other FIR named accused persons opened fire, which did not hit the informant and then, started assaulting with Lathi Danda and further, co-accused Anil Rai took out Rs. 5,000/- from the pocket of the informant and the petitioner snatched gold Bajrangbali.

Submission is of false implication. There is case and counter case. Admittedly, due to land dispute, the occurrence has taken place. The prosecution story does not appear to be

Patna High Court Cr.Misc. No.7128 of 2017 (2) dt.27-02-2017 2/2 probable and reliable. No fire-arm injury has been caused to anyone and as such, the petitioner deserves sympathetic consideration.

The learned APP opposes the prayer of pre-arrest bail.

In the facts and circumstances stated above, the petitioner named above, in the event of his arrest or surrender before the court below within four weeks from the date of receipt/production of copy of this order, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Raghopur P.S. Case No. 75 of 2016 to the satisfaction of learned ACJM-IV, Vaishali at Hajipur subject to condition as laid down u/S 438(2) of the Code of Criminal Procedure Code.
