JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 08-02-2022 Learned counsel for the petitioner is directed to remove all the defects pointed out by the Stamp Reporter within one month. Heard learned counsel for the petitioner as well as learned APP for the State through video conferencing. Learned counsel for the petitioner wants to withdraw the anticipatory bail petition in respect of petitioner No. 1, Ravi Patel, as he has been arrested during pendency of this anticipatory bail petition.

Accordingly, the anticipatory bail petition in respect of petitioner No. 1 is dismissed as withdrawn.

The petitioner No. 2 apprehends his arrest in connection with Bhabua P.S. Case No. 538 of 2020, registered for the offences punishable under Sections 147, 148, 149, 279, 323, 337, 307, 427, 504 of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel for the petitioner has submitted that there is case and counter case and both the parties have sustained injuries. Although, injured Himanshu Tiwari sustained grievous injury on his nose but it does not attributed against the present petitioner rather it has been attributed to petitioner No. 1, Ravi Patel, whose anticipatory bail petition has been dismissed as withdrawn as he has been arrested.

Considering the above-mentioned facts and circumstances, let the petitioner be released on anticipatory bail in the event of his arrest or surrender within four weeks before the learned court below on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kaimur at Bhabua in connection with Bhabua P.S. Case No. 538 of 2020, subject to the conditions as laid down under Section 438(2) Cr.P.C. Office shall ensure that all defects are removed by the petitioner within the stipulated time provided in para-1 hereinabove, failing which the matter shall be brought to the notice of this Court.
