1. Heard learned counsel for the petitioner and learned APP for the State.
2. The petitioner seeks bail in a case registered for the offences punishable under Sections 30(a), 41(1) and 41(2) of the Excise Act.
3. The learned counsel for the petitioner submits that the petitioner has antecedent of one case under the Excise Act and allegation is of recovery of 320 litres of spirit from a place behind the house of Manoj.
4. The learned counsel for the petitioner submits that since petitioner resides at a place nearby to the place of occurrence, hence based on suspicion, he came to be arrested and it is submitted that petitioner will not abscond rather will

5. Learned A.P.P. opposes the bail application.
6. Considering the submissions made by the learned counsel for the petitioner, the petitioner, above-named, is directed to be released on regular bail on his furnishing bailbonds in the sum of Rs.5,000/- (Rupees Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Trial Court where the case is pending/successor Court in connection with Excise Case No.126 of 2026.
7. The application stands allowed.
