JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 22-11-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Section 364(A) of the Indian Penal Code.
No doubt, petitioner is not named in the first information report but in course of investigation, he was identified by the victim as well as his mother in Test Identification Parade. Although, learned counsel appearing for the petitioner tried to convince me about the reliability and credibility of Test Identification Parade submitting that aforesaid Test Identification Parade was held after long delay but I am not, at all, convinced with the aforesaid submission.
Patna High Court Cr.Misc. No.38518 of 2016 (3) dt.22-11-2016 2/2 Accordingly, the prayer for bail of the petitioner in connection with Mushari P.S. Case No. 209 of 2015 pending in the court of 11th Additional Sessions Judge, Muzaffarpur stands rejected.
