JUSTICE DINESH KUMAR SINGH ORAL ORDER 29-08-2016 Heard learned counsels for the petitioner and the State. The petitioner being husband of the informant is languishing in custody since 5.6.2016 in a case registered under Sections 323, 498A and 315 of the Indian Penal Code and sections 3 and 4 of Dowry Prohibition Act.

The basic accusation is of torture for non fulfillment of dowry demands and getting the pregnancy terminated. It is submitted by the learned counsel for the petitioner that the petitioner admits his marriage with the informant. There is no proof with regard to the pregnancy being terminated. The petitioner is ready to keep the informant as wife with full dignity and honour. Statement to that effect has been made in paragraph 11 of the petition which reads as follows:

Patna High Court Cr.Misc. No.36903 of 2016 (2) dt.29-08-2016 2/2 " That, the petitioner is ready to keep her wife with full dignity."

Considering the present stand of the petitioner, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M. Ist Class, Birpur (Supaul) in connection with Karjain P.S. Case No. 4 of 2016. (Dinesh Kumar Singh, J) Anil/- U T
