Petitioner is apprehending arrest in connection with Goraul (Vaishali) P.S.Case No. 278 of 2019 for the offence under Sections 366A, 504/34 of the Indian Penal Code and later on Sections 263, 354, 342, 323 of the Indian Penal Code and Section 8 of the POCSO Act were added.

Learned counsel for the petitioner would submit that the petitioner has no criminal antecedent. He was not named in the FIR. In the statement of the victim under Section 164 of the Cr.P.C. she has named this petitioner as a witness in the Hajipur Court at the time of court marriage. Except the statement of the victim under Section 164 of the Cr.P.C., there is no other

Patna High Court CR. MISC. No.25911 of 2020(2) dt.05-11-2020 2/2 material to connect the petitioner in the commission of the crime. He further submits that other co-accused similarly circumstance have been granted anticipatory bail from a coordinate Bench of this Court.

Considering the aforesaid, the Court is inclined to grant anticipatory bail to the petitioner, let the petitioner named above, be released on bail in the event of arrest or surrender before the court below within a period of one month from the date of communication of a copy of this order on furnishing bail bond of Rs.50,000/- (fifty thousand) with two sureties of the like amount each to the satisfaction of learned Ist Additional Sessions Judge-cum-Special Judge, Vaishali at Hajipur in connection with Goraul P.S.Case No.278 of 2019 with condition that both the bailors should be father and mother of this petitioner and also subject to the condition as laid down under section 438(2) of the Cr.P.C.
