JUSTICE SANDEEP KUMAR ORAL ORDER 17-05-2023 Heard learned counsel for the petitioners and learned Additional Public Prosecutor appearing on behalf of the State. The petitioners seek regular bail in connection with Madhepura P.S. Case No. 541 of 2021, registered for the offence punishable under Sections 498(A), 304(B)/34 of the Indian Penal Code and section 3/4 of the Dowry Prohibition Act. Learned counsel for the petitioners submit that the petitioners are innocent and falsely been implicated in this case. Petitioners have got clean antecedent. Petitioners are in custody since 06.11.2022.

Patna High Court CR. MISC. No.22784 of 2023(2) dt.17-05-2023 2/2 Learned APP has vehemently opposed the prayer for bail.

Considering the fact that the petitioners are in-laws of the deceased, their period of custody, this application is allowed. The bail bonds of the petitioners shall be accepted only when the husband of the deceased surrenders and the charge is framed against the petitioners.

Let the petitioners, above named, be released on bail, on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Madhepura, in connection with Madhepura P.S. Case No. 541/2021.
