JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 16-10-2015 Heard learned counsel for the petitioners and the State. The petitioners apprehend their arrest in a case under Sections 323, 379, 435, 504, 506/34 of the Indian Penal Code and Sections 3(i), (xi) of the SC/ST Act.

The petitioners submit that no case has been made out under Sections SC/ST Act, as according to the prosecution case the incident took place inside the house. They further submit that the complaint has been filed after delay of 27 days. The accused side had earlier filed a case against the informant. Considering the facts and circumstances of the case, if the petitioners surrender within four weeks from today, they would be released on bail on furnishing bail bonds to the satisfaction of the court concerned subject to the conditions that they would not physically absent for two consecutive dates till charges are framed.
