The petitioners apprehend their arrest in connection with Sahebpur Kamal P. S. Case No. 101 of 2015 instituted under Sections 341, 323, 504, 379, 384, 385 and 506/34 of the Indian Penal Code.

The allegation, in brief, is that the petitioners demanded extortion money of Rs. 20,000/- from the informant and assaulted him and his family and snatched away Rs. 5000/- from his pocket as well as silver chain from his wife. Learned counsel for the petitioners submits that the petitioner no. 1 is the sister of the informant and other petitioners

Patna High Court Cr.Misc. No.5653 of 2017 (2) dt.07-02-2017 2/2 are also agnates of the informant and when the petitioners claimed share in the ancestral property, therefore, this false case has been lodged and from the FIR, it appears that petitioner no. 1 has settled in the same village after marriage.

Considering the aforesaid facts and circumstances of the case, let the petitioners, named above, in the event of arrest or surrender before the court below within four weeks from today, be released on bail upon furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Begusarai in connection with Sahebpur Kamal P.S.Case No. 101 of 2015; subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure, 1973.
