The petitioners apprehend their arrest in Halsi P.S. Case No. 158 of 2016 instituted for the offence under sections 272, 273, 290 of the Indian Penal Code and Section 47(i), 57(i) of the Bihar Excise (Amendment) Act, 2016.

It is alleged that one and half litre country-made liquor and seven pouches of Masaledar country-made liquor, each containing 200 ml. were recovered from the house of Pyare Choudhary.

Pyare Choudhary was arrested and seizure list was prepared which bears his signature.

It has further been alleged that son and wife of Pyare

Patna High Court Cr.Misc. No.10711 of 2017 (2) dt.18-03-2017 2/2 Choudhary (Petitioners) managed to run away. In this manner, from the written report itself, it appears that petitioners were not present on the spot. It is mentioned in para-3 that the petitioners have no criminal antecedent.

Considering the facts and circumstances of the case, prayer for anticipatory bail of the petitioners is allowed. In the event of surrender/arrest of the petitioners named above, within six weeks from today, in connection with Halsi P.S. Case No.158 of 2016, they shall be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-III, Lakhisarai, subject to the conditions as laid down under Section 438(2) Cr.P.C.
