Petitioner apprehends his arrest in a case registered for offence punishable u/s 25(a-b)a/26 of Arms Act and 18(C)/21/22 N.D.P.S. Act and 18(C)/27 Drugs and Cosmetic Act. Allegedly, a raid was conducted in Shanti Lodge, M.P. Dwivedi Road, Bhagalpur and one person sitting in the reception counter tried to escape but was apprehended. From the drawer of the reception counter, a live cartridge was found. Further, one country made pistol, altogether 1.400 liter of DIALEX T.M. D.C cough syrup was recovered.
It is submitted by learned senior counsel for the petitioner that petitioner is quite innocent and has committed no offence.
Patna High Court CR. MISC. No.21967 of 2023(2) dt.03-07-2023 2/2 He has been falsely implicated in this case and has no criminal antecedent. The allegation leveled against the petitioner is not specific rather general and omnibus in nature. Petitioner is the owner of the said Shanti Lodge and on that basis, he was made accused in this case. Petitioner had no knowledge about any such article kept in his lodge as he has appointed a Manager for the Lodge. No incriminating article has been recovered from the conscious physical possession of the petitioner. Petitioner has no criminal antecedent.
Learned APP for the State opposed the prayer for bail. Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/Successor Court in connection with Kotwali P.S. Case No.1198/2022, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Anjani Kumar Sharan, J) pallavi/- U T
