For issuance of writ in the nature of certiorari quashing the impugned Memo No. 95 dated 17.2.2009 issued by the Director Administration, Rajendra Agriculture University, Bihar, Pusa, Samastipur by which the case of the petitioner has not been considered for regularization as per the guideline fixed by the Hon'ble the Apex Court

No. 18594 of 1994 although the petitioner is meeting out all the requisite required qualification and experienced as per the guideline fixed by the Hon'ble Apex Court in aforesaid S.L.P. to the impugned order as contained in Annexure-1 is contemptuous in nature."

Learned counsel for the petitioner seeks permission to withdraw the present petition reserving liberty to file a fresh representation before the competent authority. Permission granted.

Needless to add, if such a representation is filed before the competent authority within a period of four weeks from today, the same shall be considered and disposed of by passing a reasoned and speaking order within a period of three months from the date of its filing along with a copy of this order, of course after complying with the principles of natural justice. Also, liberty reserved to the petitioner to take recourse to such other remedies as are otherwise available in accordance with law, before the appropriate forum.

It is made clear that this Court has not expressed any opinion on the merits of the case and all issues are left open. The instant petition stands disposed of as withdrawn with the aforesaid liberty/observation.
