The petitioner apprehends his arrest in Sono P.S. Case No.96 of 2011 for the offences punishable under Sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act. It has been submitted on behalf of the petitioner that the allegation against the petitioner and other accused persons is that they have fired twice, but there is only one gun shot injury and further petitioner has no knowledge about the case and he is declared absconder in this case.
Heard learned A.P.P. also.
Having heard both sides. In view of the fact that there is direct allegation against the petitioner and the impugned order shows that he is declared absconder in this case, let the petitioner,
Patna High Court Cr.Misc. No.6297 of 2017 (2) dt.20-02-2017 above named, surrender in the court below within a period of four weeks and make prayer for regular bail which shall be considered on its own merit, without being prejudiced by this order. With the above observation, this application is disposed of.
