The petitioner seeks regular bail in connection with Excise Case No. 493 of 2018 for the offenses punishable under Section 30(a) of the Bihar Excise Act, 2016.
The allegation is regarding recovery of 43.8 liters of Nepali Soufi wine from the place of occurrence and while the petitioner and others were fleeing away, they were caught and three motorcycles were also recovered.
The learned counsel for the petitioner submits that the petitioner is innocent and he has been falsely implicated in the present case. It is also submitted that the said motorcycles apprehended by the Police do not belong to the petitioner herein and the petitioner is having a clean antecedent. The petitioner is
Patna High Court Cr.Misc. No.72624 of 2018(2) dt.14-12-2018 2/2 stated to be languishing in custody since 29.09.2018. Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, East Champaran at Motihari in connection with Excise Case P.S. Case No. 493 of 2018.
