JUSTICE VINOD KUMAR SINHA ORAL ORDER 07-03-2019 This is an application for grant of anticipatory bail in connection with Complaint Case No. 493 (C) of 2017, disclosing offences under Section 420 of the Indian Penal Code and Section 138 of the Negotiable Instrument Act. Allegation against the petitioner is that he has issued a cheque of Rs.85,000/-, but the same has bounced. Submission of learned counsel for the petitioner is that he is ready to pay the amount and ready to abide by any condition imposed upon him.
Heard learned A.P.P. as well as opposite party no.2 also.
Having heard both sides, in view of the facts and

No.168 of 2019(3) dt.07-03-2019 2/2 circumstances of the case, this application is disposed of with a direction to the petitioner to surrender within a period of eight weeks before the learned court below along with bank draft of Rs.85,000/- drawn in favour of opposite party no.2 and on depositing the amount, the petitioner will be released on bail by the court below on furnishing bail bonds of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the court concerned. It is needless to say that the above amount so deposited will be subject to outcome of the case and may be released in favour of opposite party No.2 on filing application.
