Petitioner apprehends his arrest in Khagaria P.S. Case No. 405 of 2014 registered under section 457 of the Indian Penal Code and 25(1-B)a, Arms Act.

The informant alleged that petitioner having armed in his hand entered into his house but the petitioner managed to flee away and the pistol was snatched from the petitioner and the same was produced before the police. It is submitted that this case is false and concocted. Petitioner is a student and his career is at stake.

On consideration of the fact that petitioner had entered into the house of the informant with arms, I am not

The petitioner if so advised , may seek regular bail and the court below shall consider the regular bail of the petitioner taking into consideration that arms was recovered and produced by the private persons which comes within the purview of section 37 of the Arms Act.
