The petitioner seeks bail in a case instituted for the offence punishable under Section 47(a)(f) of the Bihar Excise Act, Sections 53, 57 of Bihar Excise (Amendment) Act, 2016 and Section 273 of the Indian Penal Code.

It is alleged that from vehicle bearing Registration No. BR-09H/8522 foreign liquor has been recovered. The petitioner was found to be sitting on the aforesaid vehicle along with other persons.

It has been submitted on behalf of the petitioner that driver of the aforesaid vehicle, namely, Dilip Kumar has been granted bail by Co-ordinate Bench of this Court vide Cr. Misc. No. 51446 of 2016 passed on 06.12.2016. Seizure list is enclosed

Patna High Court Cr.Misc. No.54100 of 2016 (2) dt.21-12-2016 2/2 with the FIR and it does not disclose that any foreign liquor has been seized from personal possession of the petitioner. Petitioner is in custody since 23.07.2016.

In the aforesaid circumstances, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jamui, in connection with Chakai P.S.
