2. The petitioner seeks regular bail in connection with Dumariya Ghat P.S. Case No. 182 of 2023 registered for the offence under Section 392 of the Indian Penal Code.

3. As per prosecution case, four miscreants at the point of pistol entered into the ICICI Bank and looted cash of Rs. 18,71,440/- from cash counter and vault. Besides it they looted some cash of customers, mobile of the employees and to create terror they fired in the air and fled away by motorcycle.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. It is further submitted that nothing has been recovered from the conscious possession of the petitioner. It is next submitted that petitioner is not named in the FIR his name

Patna High Court CR. MISC. No.28723 of 2024(3) dt.20-05-2024 2/2 surfaced on the basis of the confessional statement of the coaccused. It is also submitted that petitioner is in judicial custody since 22.08.2023. Similarly situated co-accused person, namely, Rajan Yadav @ Raj Kumar Yadav has already been granted bail by this Court in Cr. Misc. No. 5256 of 2024 vide order dated 21.03.2024.

5. However, learned APP for the State vehemently opposed the prayer for regular bail.

Considering the aforesaid facts and circumstances of the case, let the petitioner, above named, be released on bail after framing of charge on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, East Champaran, Motihari in connection with Dumariyaghat P.S. Case No. 182 of 2023.

7. The trial court is directed to conclude the proceeding of framing of charge according to law within a period of 15 (fifteen) days from the receipt of a copy of this order.
