====================================================== CORAM: HONOURABLE MR. JUSTICE PURNENDU SINGH ORAL ORDER 24-04-2024 Heard Mr. Pankaj Kumar Sinha, learned counsel appearing on behalf of the petitioner and Mr. Surendra Kumar, learned APP for the State.
2. The petitioner seeks pre-arrest bail in connection with Complaint Case No. 1082C of 2023 registered for the offence punishable under Sections 417, 420, 468/34 of the Indian Penal Code.
3. As per the allegation made in the F.I.R., on the pretext of selling second hand Scorpio vehicle, the complainant had transferred a sum of Rs. 3,13,000/- in the account no. 38390100000666 of co-accused Ashutosh Kumar and Rs. 71,000/- in the account no. 1812764949 of co-accused Mithun Pandit.
4. Learned counsel appearing on behalf of the
Patna High Court CR. MISC. No.25527 of 2024(2) dt.24-04-2024 2/2 petitioner submitted that the petitioner is innocent and he has falsely been implicated in the case. The petitioner had only introduced the complainant with the co-accused Mithun Pandit and the complainant at his own had transferred the amount in the account of the co-accused as alleged in the complaint.
5. Learned APP for the State has vehemently opposed the prayer for grant of pre-arrest bail to the petitioner.
6. Considering the nature of allegation made against the petitioner, the petitioner, above named, is directed to be released on pre-arrest bail, in the event of his arrest or surrender before the Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Jamui in connection with Complaint Case No. 1082C of 2023, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
