Petitioner seeks bail in connection with Kharagpur P.S. Case No. 110 of 2016 registered for the offences punishable under Sections- 324, 307, 34 of the Indian Penal Code.
Learned counsel for the petitioner submits that petitioner has been implicated in this case on suspicion. During investigation nothing has come against this petitioner. Petitioner has no criminal antecedent.
Learned Addl. P.P. appearing for the State opposes the prayer for bail and submits that there is direct and specific allegation against this petitioner. During investigation,
Patna High Court Cr.Misc. No.8709 of 2017 (4) dt.12-05-2017 2/2 witnesses have supported the prosecution case. It has come in the diary that informant with his wife appears to have left the village due to fear of the petitioner.
Considering the nature of allegations levelled against the petitioner and the submissions made on behalf of the parties, I do not feel inclined to grant the privilege of anticipatory bail to the petitioner. His prayer for anticipatory bail is, therefore, rejected.
