The petitioner has filed the present writ application for issuance of writ in the nature of mandamus commanding and directing upon respondent no. 5 to expedite the hearing of Encroachment Case No. 2/18-19 pending before the Circle Officer and thereafter remove the encroachment from the public land recorded as unabad jamin Ahar situated at Mauza Laxmanpur, Bikramganj, District- Rohtas appertaining to Khata Nos. 124, 125, Khesara No. 439 area 1.32 acre, Khesara No. 684, Area 2.78 acre, Khesara No. 364 area 1.25 acre encroached by some of the villagers causing inconvenience to the public at
Patna High Court CWJC No.6586 of 2019(2) dt.03-04-2019 2/2 large. The petitioner has further prayer for a direction upon respondent no. 5 to comply with the order passed by respondent nos. 2, 3 and 4 by which direction has been given to get the land measured and remove the encroachment from the public land. Counsel for the petitioner submits that the private respondents have encroached upon the public land regarding which Encroachment Case No. 2/18-19 was initiated. The said proceeding is still pending.
The Respondent No. 5 (the Circle Officer, Bikramganj, Rohtas) is directed to look into the matter and dispose of the aforesaid Encroachment Case No. 2/18-19 in accordance with law within a period of four months from the date of receipt/production of this order after giving opportunity to all the concerned parties.
With the aforesaid observation/direction, the present writ application stands disposed of.
