JUSTICE VINOD KUMAR SINHA ORAL ORDER 23-12-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The application is for grant of bail for the offence under Sections 399, 402, and 414 of the Indian Penal Code as well as Sections 25 (1-B)a, 26 and 35 of the Arms Act. It is submitted on behalf of the petitioner that the allegation against the petitioner is that he was arrested at the spot and one loaded country-made Pistol was recovered from the possession of the petitioner. It has further been submitted that the petitioner is in custody since 11.09.2016 and the charge-sheet has also been submitted.

Heard learned A.P.P. also.

Having heard both sides. In view of the facts and

Patna High Court Cr.Misc. No.54097 of 2016 (2) dt.23-12-2016 2/2 circumstances of the case, at present, I am not inclined to grant bail to the petitioner, accordingly, the same is rejected. However, the petitioner may renew his prayer for bail after framing of the charges in this case.
