JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-12-2018 The petitioner seeks bail in connection with Sahebpur Kamal P.S.Case No. 63 of 2017 registered under Sections 302/34 and 120B of the Indian Penal Code and 27 of the Arms Act.
Earlier prayer for anticipatory bail of the petitioner was dismissed vide order dated 21.11.2018 passed in Cr. Misc. No. 51008 of 2017 and it appears that petitioner conspiring with other accused persons killed deceased as he was a witness in a murder case and he is accused in 16 cases.
Submission of learned counsel for the petitioner is that in three cases petitioner has been acquitted and up-till-now two witnesses have been examined.
Heard learned APP also.
Having heard both sides and in the facts and circumstances, as stated above, I am not inclined to grant bail to
Patna High Court Cr.Misc. No.74661 of 2018(2) dt.20-12-2018 2/2 the petitioner. However, trial court is directed to expedite the trial and try to conduct on regular basis.
