The petitioner is languishing in custody for the offences punishable under Sections 420, 467, 468, 471, 120(B) of the I.P.C., Sections 30(a)/36/41(1) of the Bihar Prohibition and Excise (Amendment) Act, 2018 and Section 27 of the Arms Act.

From a truck liquor was being unloaded and allegation is that the petitioner was along with his motorcycle and 9 litres of liquor was recovered from his motorcycle. Petitioner has got identical criminal antecedent. Investigation of the case is already complete. Petitioner is in custody since 06.02.2021.

Considering entire facts, let the petitioner, above

Patna High Court CR. MISC. No.32129 of 2021(3) dt.23-09-2021 2/2 named, be released on bail, after framing of the charges so that the trial may not hamper, on furnishing bail bond of Rs. 20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Bodhgaya P.S. Case No. 36 of 2021, with following conditions: (a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

(c) The petitioner shall not leave the country without permission of the trial Court.

The learned trial court shall expedite the framing of the charges.
