1. Heard learned counsel for the petitioner and the learned APP for the State.

2. Petitioner seeks regular bail in connection with Bidupur P.S. Case No. 592 of 2022 dated 07.11.2022 registered for the offences punishable under Sections 363 and 366A/34 of the Indian Penal Code.

3. The main submissions advanced by learned counsel for the petitioner are that the instant matter relates to elopement and there was love affair in between the informant's sister and brother of this petitioner and the petitioner and his entire family members have been made accused in this case mainly on account of being the relatives of the main co-accused Saurabh Yadav, in fact on account of the said love affair the informant's sister and petitioner's brother ran away with money and

No.22550 of 2023(2) dt.23-05-2023 2/3 ornaments of their respective families and the petitioner has fair and clean antecedent and has been languishing in jail since 28.11.2022 and against him, the investigation has been completed and there is no allegation against him except being the relative of the main co-accused Saurabh Yadav and the allegation levelled in the FIR is completely false, in actual the informant's sister left her parent's house according to her own will and consent owing to having love affair with petitioner's brother.

4. Learned APP appearing for the State opposes the bail prayer.

Considering the above submissions and mainly the facts that as per the FIR, the main allegation is against coaccused Saurabh Yadav, who happens to be the brother of this petitioner and most of the family members including the petitioner and the said co-accused named-above, have been made accused in this case and against the petitioner, the investigation has been completed and moreover, the petitioner is stated to be a young person having fair and clean antecedent, in my opinion it is a fit case for bail to the petitioner. Accordingly, let the petitioner named-above be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the
