JUSTICE BIRENDRA KUMAR ORAL ORDER 16-03-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 325, 363 and 366A of the Indian Penal Code.

Allegation is of kidnapping of Arti Kumari, the minor daughter of the informant.

The victim-girl in her statement under Section 164 Cr.P.C. alleged that the petitioner and co-accused forcefully committed rape against her on 05.10.2016. Thereafter they took her to Bombay where she was along with Sanjay Ram. Anyhow she could flee away to her house.

Submission of the petitioner is that the matter appears to be of love-affairs and that is why there is delay in lodging the

Patna High Court Cr.Misc. No.9747 of 2017 (2) dt.16-03-2017 2/2 FIR.

Considering the nature of allegation against the petitioner, I am not inclined to grant the petitioner anticipatory bail in connection with Nabinagar Police Station Case No. 172 of 2016 pending in the court of learned Chief Judicial Magistrate, Aurangabad.

Hence, prayer for bail is refused.
