JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 20-05-2024 Heard learned counsel for the petitioner and the State.

2. The petitioner apprehends arrest in a case registered for the offence punishable under sections 147, 148, 149, 302 of the Indian Penal Code and section 27 of the Arms Act.

3. As per the prosecution case, all the FIR named accused persons including this petitioner made firing on the informant and his son. Son of the informant sustained injuries and died on way to the hospital.

4. Learned counsel appearing for the petitioner submits that because of political rivalry between the parties in the wake of Lok Sabha election, petitioner has falsely been implicated in this case. Moreover, specific allegation of firing is against co-accused Nawab Mian, Ataul Ansari, Haidar Mian and Ibrar Mian and allegation against the petitioner is that he and other accused persons caught hold of the victim. 5. Considering the aforesaid facts of the case, prayer for bail of the petitioner is allowed. In the event of arrest/surrender within six weeks from today, let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Jamui in Khaira Police Station Case No. 116 of 2019, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
