JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 06-01-2022 Heard learned counsel for the petitioner and learned A.P.P for the State through video conferencing. The petitioner seeks bail in Bodh Gaya P.S. Case No. 387 of 2020, registered for the offence punishable under Sections 302, 201/34 of the Indian Penal Code. As per the prosecution case, this petitioner along with other accused persons called the son of informant and took away him somewhere else. Later on, dead body of son of informant was found in Pain of Fulchatar.

It is submitted on behalf of the petitioner that petitioner has been made accused in this case only on suspicion. No one has seen this petitioner killing the son of informant. Petitioner is in custody since 13.11.2020 having no criminal antecedent.

Patna High Court CR. MISC. No.34113 of 2021(2) dt.06-01-2022 2/2 Learned APP however, vehemently opposed the prayer for bail and submitted that dead body of deceased was found on the disclosure made by the petitioner and he has strong motive as the deceased had love affairs with the sister-in-law of the petitioner.

Considering the facts aforesaid and the nature of allegation, I am not inclined to enlarge the petitioner abovenamed on bail. Accordingly, the same is rejected. (Prabhat Kumar Singh, J) vinita/- U T
