JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 18-11-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Section 379 of the Indian Penal Code. The present case was lodged against unknown and police after investigation, submitted final form showing the matter clueless. The final form was submitted in the year 2015. Subsequently, the stolen motorcycles were recovered from the garage of a mechanic in Mughalsarai for which a case was registered in Kotwali Mughalsarai. The stolen motorcycle of the present case was also recovered in the aforesaid case and the aforesaid mechanic confessed his guilt disclosing the name of

Patna High Court Cr.Misc. No.39558 of 2016 (4) dt.18-11-2016 2/2 petitioner and others and on the basis of aforesaid disclosure, petitioner was remanded in this case.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bhojpur at Ara in connection with Ara Nawada P.S. Case No. 449 of 2014.
