====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 05-12-2018 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Sessions Trial No. 161 of 2018 arising out of Forbesganj P.S. Case No. 79 of 2018 instituted for the offence under Sections 302/34, 394, 411 and 413 of the Indian Penal Code.

Counsel for the petitioner submits that petitioner is not named in the written report. The police has arrested this petitioner in connection with Forbesganj P.S. Case No. 89 of 2018 in which he was an accused and recorded his confessional statement. On the basis of that confessional statement, the police has remanded the petitioner in the instant case. In the written report it is alleged that some unknown persons have murdered night guard namely Bhudhi Lal Khawas who was working in the factory of informant.

Patna High Court Cr.Misc. No.72049 of 2018(2) dt.05-12-2018 2/2 Counsel for the petitioner submits that Md. Ahmad @ Ahmad @ Babli who has taken the name of this petitioner has already been granted bail by coordinate Bench of this Court vide order dated 4.10.2018 passed in Cr. Misc. 55125 of 2018.

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned 1st Additional Sessions Judge, Araria, in connection with Sessions Trial No. 161 of 2018 arising out of Forbesganj P.S. Case No. 79 of 2018 subject to the condition that both the bailors will be the close relatives of the petitioner.
