The petitioner seeks regular bail in connection with Begusarai Town P.S.Case no.411 of 2018 registered for offences punishable under Sections 3/4 of the POCSO Act. Allegation against the petitioner is of having unnatural intercourse with the son of the informant.

Submission of the learned counsel for the petitioner is that there was scuffle between the victim while they were playing cricket and no such occurrence has been caused as alleged in the FIR. He is in custody for five months. The medical report does not support the prosecution case. Heard learned A.P.P. , who has opposed the prayer for bail.

No.73870 of 2018(2) dt.14-12-2018 2/2 Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned ADJ Ist cum Special Jduge POCSO Act, Begusarai in connection with Begusarai Town P.S.Case No.411 of 2018 & POCSO Case No.66 of 2018. With the aforesaid observation, this application is allowed.
