2. Petitioner apprehends arrest in a case registered for the offence punishable under Section 30(a) of Bihar Prohibition and Excise Act.

3. As per prosecution case, 302.4 liters foreign liquor was recovered from the seized Brezza car. Petitioner is alleged to be owner of the seized car.

4. Learned counsel for the petitioner submits that no incriminating material has been recovered from conscious possession of the petitioner. Petitioner has got no concern with the alleged recovery and he has been made accused in this case only on suspicion. As a matter of fact, car of the petitioner was robbed by some unknown miscreants on 6.6.24, while petitioner was travelling to Patna. Petitioner claims clean antecedent.

5. Learned A.P.P. for the State opposes the prayer for bail of petitioner and submits that petitioner is registered owner of the seized car from which huge quantity of illicit liquor was recovered and complaint for the same was filed by the petitioner after institution of F.I.R. for the instant bail application.

6. Considering the aforesaid facts and circumstances of the case, prayer for anticipatory bail of the petitioner is refused.
