JUSTICE MOHIT KUMAR SHAH ORAL ORDER 21-08-2019 The present petition has been filed for modifying the order dated 18.12.2018 passed in CWJC No. 4857 of 2017, to the extent that since the petitioner had already filed an appeal, before passing of the aforesaid order dated 18.12.2018, the requirement of filing appeal be dispensed with.

Per contra, the learned counsel appearing for the respondents submits that the appeal of the petitioner, as filed by him, has already stood dismissed by an order dated 16.07.2019. Accordingly, the present modification petition stands disposed off with liberty to the petitioner to assail the appellate order dated 16.07.2019, if so advised.
