JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 06-09-2022 At the outset of argument learned counsel for the petitioners seeks permission to withdraw the anticipatory bail petition of petitioner No.2.

Prayer is allowed.

This anticipatory bail petition is dismissed as withdrawn against petitioner No.2.

Heard learned counsel for the parties.

Petitioner No.1 apprehends his arrest in a case registered for the offence punishable under Section 307, 379 and some other ancillary Sections of the Indian Penal Code and u/s 27 of Arms Act.

As per the prosecution case, petitioner and co-

Patna High Court CR. MISC. No.22822 of 2022(2) dt.06-09-2022 2/2 accused, Santosh Kumar assaulted the informant with bamboo stick.

Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the case. The injury sustained by the informant is simple in nature. Learned counsel appearing for the State and the informant opposed the prayer for anticipatory bail and submits that petitioner No.1 is named in the FIR and he has got criminal antecedent also.

Considering the facts of the case, nature of accusation made against the petitioner, let the petitioner No.1, above named, in the event of his arrest/ surrender within a period of six weeks from today shall be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Purnea in connection with Tikapatti PS case No.06/ 2022, subject to conditions laid down u/s 438(2) of the Cr.
