The petitioner is in custody in connection with S.T Case No. 07 of 2023 arising out of Kasim Bazar P.S. Case No. 266 of 2022 for the offence under Sections 420, 376 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent and he is in custody since 12.10.2022.

It has been alleged that petitioner on the assurance of marriage established physical relationship several times with the informant. The informant is a major.

Considering the fact that the informant is a major and prima facie it appears that it was a consensual sex. The petitioner, named above, is directed to be released on bail on
