JUSTICE VIKASH JAIN ORAL ORDER 12-10-2020 Heard learned counsel for the petitioners and learned APP for the State through video conference. Learned counsel for the petitioners undertakes that all defects pointed out by the Stamp Reporter shall be removed, and compliance with the conditions of the notices of this Court with regard to acceptance of e-filing shall be made, without delay immediately upon resumption of normal physical functioning of the Court, and in any event within one month thereof.

2. The petitioners are in custody since 14.02.2020 in connection with Sessions Trial No. 227 of 1997 arising out of Rajepur P.S. Case No. 11 of 1996 for the alleged offences under Sections 447, 323, 379, 504/34 of the Indian Penal Code.

3. It is submitted that the petitioners have been falsely implicated in connection with assault on the informant and his family members owing to past enmity. It is further submitted that earlier the petitioners had been granted bail by the learned court below and due to the fault of their pairvikar they could not be represented before the learned Court below on the dates fixed, which resulted in cancellation of their bail bond. The petitioners undertake to appear before the learned Court below on each and every date. The petitioners claim

4. Learned APP appears and has been heard.

5. Be that as it may and having regard to the period of custody already suffered since 14.02.2020, let the petitioners above named be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of like amount each to the satisfaction of learned Additional District & Sessions Judge-17, Motihari, East Champaran, in connection with Sessions Trial No. 227 of 1997 arising out of Rajepur P.S. Case No. 11 of 1996, if they are not otherwise required in any other case.

6. Office shall follow-up to ensure that all defects are removed and compliance with the notices of this Court are made by the petitioners within the stipulated time provided in para 1 hereinabove, failing which the matter shall be brought to the notice of this Court.
