Heard the parties in virtual Court.
The petitioner is languishing in custody for the offence punishable under Section 30(a) of Bihar Prohibition and Excise Act, 2018.
Allegation is of recovery of liquor. Petitioner has got an identical criminal antecedent. Investigation of the case is already complete.
Considering the quantum of recovery, let the petitioner, above named, be released on bail only after framing of the charges so that trial may not hamper on furnishing bail bond of Rs.20000/- (Twenty thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below
Patna High Court CR. MISC. No.32103 of 2021(2) dt.29-10-2021 2/2 where the case is pending in connection with Khagaria P.S. Case No. 174 of 2021 corresponding to Special B.A. (Excise) No.191 of 2021, with following conditions:
(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.
(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
(c) The petitioner shall not leave the country without permission of the trial Court.
