Heard the parties in virtual Court.
The petitioner is languishing in custody for the offence punishable under Sections 30(a),41,47 of Bihar Prohibition and Excise (Amendment) Act, 2016. Petitioner is Conductor of the Bus from which more than 100 litre of foreign liquor was recovered. Petitioner has got no criminal antecedent. Petitioner is in custody since 12.02.2021.
Submission is that the petitioner had no knowledge about the liquor.
Since this is the first allegation against the petitioner under Bihar Prohibition and Excise Act, let the petitioner, above
Patna High Court CR. MISC. No.32098 of 2021(2) dt.29-10-2021 2/2 named, be released on bail on furnishing bail bond of Rs.20000/- (Twenty thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Spl.Excise Case No.113 of 2021 arising out of Baisi P.S. Case No. 54 of 2021, with following conditions:
(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.
(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
(c) The petitioner shall not leave the country without permission of the trial Court.
