Although in this application under Article 227 of the Constitution of India, prayer has been made by the petitioner for directing the Court below to conclude the proceeding of Execution Case No.79 of 2012, at the time of hearing of this writ application on merit in admission matter, the learned counsel, Mr. J.S. Arora, for the petitioner submitted that in fact he has challenged the order dated 27.09.2013.

Perused the order dated 27.09.2013. The Court below has simply adjourned the case for 01.11.2012 on the ground of Civil Revision No.126 of 2013 is pending before the High Court.

In view of the above position, there is no question of any prejudice to the petitioner and that the order in no way occasion failure of justice and, therefore, this writ application is dismissed. Sanjeev/- (Mungeshwar Sahoo, J) U
