JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 05-01-2015 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners apprehend their arrest in connection with Sikarhata Police Station Case No. 30 of 2014 registered for the offences punishable under Section 307 and other minor sections of the Indian Penal Code.
There are allegations against these petitioners that they along with others badly assaulted the informant and his other family members by means of different weapons. Annexure-2 series reveals that altogether six persons sustained injury in the alleged occurrence and out of one injured namely Sogra Khatoon sustained altogether eleven injuries on her body out of which one injury has been found grievous. Although there is no specific allegation against these petitioners but taking into consideration
Patna High Court Cr.Misc. No.51834 of 2014 (2) dt.05-01-2015 2/2 the nature of injuries as well as manner in which six persons were badly assaulted by the petitioners and their companion, I am not inclined to grant privilege of anticipatory bail to the petitioners, accordingly, their prayer for anticipatory bail stands rejected.. However if petitioners surrender before the concerned court within four weeks from today and seek regular bail the concerned court shall consider regular bail application of the petitioners on its own merit without being prejudiced of this rejection order.
