The petitioner, who superannuated from the post of Head Clerk on 31.03.2022 from Kishori Sinha Mahila Mahavidyalya, Aurangabad, has approached this Court seeking a direction upon the respondent to extend the post retiral benefits including the Group Insurance, Earned Leave, the benefits accrued after granting ACP/MACP and arrears due as per the recommendation of the 7th Pay Commission along with statutory interest.

3. A counter affidavit has been filed on behalf of

Patna High Court CWJC No.6949 of 2023(8) dt.23-06-2026 2/3 respondent nos. 2 to 4. It is submitted that the amount of gratuity, Earned Leave and Group Insurance has already been paid to the petitioner long back in the year 2023 itself. Further the arrears of pension has also been paid to the petitioner. So far the benefit of ACP/MACP is concerned, it is submitted that the same was made available to the college when he was posted as Head Assistant and no such claim is pending at University level.

Learned Advocate for the petitioner at this juncture submitted that despite the conscious decision taken by the State that the employees of the University shall also be entitled to get the revised pay scale on the basis of recommendation of 7th Pay Commission, till date it has not been paid to the petitioner.

5. Learned Advocate for the University submits that the counter affidavit was filed on 13.02.2024 and more than two years have been passed. It appears that the same has also been paid to the petitioner.

6. Be that as it may, considering the submissions advanced and averments made in the counter affidavit filed on behalf of the State as well as University, the present writ petition stands disposed off.

7. However, in case, the petitioner still has any grievance with respect to the payment of arrears of

Patna High Court CWJC No.6949 of 2023(8) dt.23-06-2026 3/3 salary/pension on account of 7th Pay Revision, he may approach before the Registrar of the University.

8. In case, such a representation is filed preferably within a period of four weeks from today, the same shall be duly considered and disposed off by a reasoned and speaking order within a further period of eight weeks.

9. It is needless to say that in case the claim of the petitioner finds favour, necessary consequential monetary benefit shall be given to him.
