Petitioner seeks bail in a case registered for the offences punishable under Sections 147, 148, 149, 308 of the Indian Penal Code and Section 27 of the Arms Act. Petitioner allegedly caused firearm injury to Rupesh Kumar. Though allegation in the F.I.R. is commission of injury at the back, however the Doctor has found injury at the right side of chest. Petitioner is in custody since 20.03.2018. Considering the fact aforesaid, let the petitioner, above named, be released on bail after framing of the charges on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned court below where the case is pending in connection with Jamalpur Police Station Case No.50 of 2018,

Patna High Court CR. MISC. No.26328 of 2019(3) dt.12-06-2019 2/2 subject to condition that both the bailors shall be resident of within the territorial jurisdiction of the learned court below and the petitioner shall fully co-operate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
