The petitioner apprehends his arrest in Nauhatta P.S. Case No.99 of 2019 registered under Sections 406, 420 and 409 of the Indian Penal Code.

The informant(Block Development Officer) alleged that the petitioner who is Mukhiya of Shahpur Panchayat and Panchayat Secretary, Subhash Singh withdrew Rs.20,90,000/- in between 18.09.2017 to 24.11.2017 from the Government amount for completion of the scheme of Mukhyamantri Jal Nal Yojna but did not even initiate the scheme. When this fact was brought to the notice of Mukhiya and Panchayat Sachiv, both deposited Rs.20,90,000/- in between 14.01.2019 to 04.02.2019. Panchayat Sachiv also deposited Rs.91,700/- as interest on the aforesaid amount.

No.20895 of 2020(2) dt.14-08-2020 2/2 The learned counsel for the petitioner submits that petitioner is Mukhiya of Gram Panchayat and on the request of the Panchayat Sachiv, who was to execute the scheme under Mukhyamantri Jal Nal Yojna, withdrew the amount but no work under the scheme was done. Later on, Panchayat Sachiv deposited entire amount with interest accruing thereon. Taking into consideration the fact that the entire amount with interest accruing thereon has already been deposited, let the petitioner, above named, in the event of his arrest or surrender within a period of four weeks be released on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri C.K.Verma, learned J.M. 1st Class, Dehri-on-sone, DistrictRohtas in connection with Nauhatta P.S. Case No.99 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
