The petitioner apprehends his arrest in Complaint Case No. 1207(C) of 2015 registered for the offences punishable under Section 498(A) of the Indian Penal Code and under Section 3/4 of the Dowry Prohibition Act.
The complainant, wife of the petitioner, alleged that she was married to the petitioner on 26.04.2012. At the time of marriage her parents gifted many articles but, the petitioner started demanding additional dowry.
Learned counsel for the petitioner submits that the petitioner is ready to keep his wife on any condition but, learned
Patna High Court Cr.Misc. No.11541 of 2017 (3) dt.23-05-2017 2/2 counsel for the complainant submits that the wife is not ready to live with her husband.
Considering the fact that the petitioner is willing to keep his wife but the wife, herself, does not want to live with her husband, the petitioner above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Learned Sub-Divisional Judicial Magistrate, Patna in Complaint Case No. 1207(C) of 2015, Subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
