JUSTICE VINOD KUMAR SINHA ORAL ORDER 14-12-2018 Petitioner prays for bail in connection with Jokihat P.S.Case No. 09 of 2002 registered for the offences punishable under Sections 364, 498A of the Indian Penal Code and cognizance has been taken under Sections 498A and 323 IPC. Allegation against the petitioner is of subjecting her wife to cruelty and she is traceless.

Submission of learned counsel for the petitioner is that charge sheet has been submitted in this case under Sections 498A and 323 IPC and petitioner is ready to co-operate with the police in tracing out his wife and he is in custody for more than three months.

Having heard both sides and in the facts and

No.73454 of 2018(2) dt.14-12-2018 2/2 circumstances, let petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Araria, in connection with Jokihat P.S.Case No. 09 of 2002, subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned and further condition is that petitioner has to co-operate with the police in tracing out his wife.
