JUSTICE RAMESH KUMAR DATTA ORAL ORDER 04-11-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. It is evident from the impugned order dated 21.5.2015 of the learned Sessions Judge that the petitioner has taken the plea of juvenility relying upon the Photostat copy of the Admit Card of the Bihar School Examination Board which showed his date of birth as 12.12.2000. The learned Sessions Judge has accordingly directed that the petitioner shall surrender before the Juvenile Justice Board within 30 days which shall determine the question of his juvenility and during the course of deciding this question the petitioner may be kept in such custody which may be deemed fit by the Juvenile Justice Board but instead of doing so the petitioner has filed this anticipatory bail
Patna High Court Cr.Misc. No.43250 of 2015 (2) dt.04-11-2015 2/2 application which does not appear to be maintainable. The application is, accordingly, dismissed with the direction to the parents, including the mother of the petitioner who has sworn the affidavit, to produce the petitioner before the Juvenile Justice Board for appropriate action in the matter within a period of four weeks from today.
