The petitioners seek bail in a case registered under Section 420/120B of the Indian Penal Code and 47(A)/54 of the Bihar Excise(Amendment) Act, 2016.
The allegation is that the police stopped two cars and recovered 151 bottles of foreign liquor and 55 pouches of country made liquor from one car and 359 bottles kept in the dickey and 186 bottles on the back seat of another car.
Learned counsel appearing for the petitioners submits that the petitioners were not the owners of any of the car. FIR does not disclose in which car petitioners were found sitting
Patna High Court Cr.Misc. No.54154 of 2016 (2) dt.21-12-2016 2/2 and apprehended. Moreover, the petitioners are students and they were waiting for bus for going to Patna and both are in custody since 27.09.2016 and they have no criminal antecedent. Considering the aforesaid facts and circumstances of the case, let above named petitioners, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Aurangabad in Barun P.S.case No. 151 of 2016.
