JUSTICE ARUN KUMAR ORAL ORDER 10-02-2017 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in connection with Vaishali Nagar P.S. Case No. 314 of 2016 registered under Sections 323, 341, 343, 504, 308, 379, 448, 147 and 148 of the Indian Penal Code.

Allegation is that the accused persons came and assaulted the informant and other family members and there is specific allegation against this petitioner that he hit by iron rod over the head of the informant.

It is stated that the petitioner is nephew of the informant and already a civil suit is going on between both sides. The allegation is of giving a single blow of iron rod over the head of the informant, but that injury is only simple in nature and the petitioner has got no criminal antecedent.

Considering the aforesaid facts and circumstances, in the event of their arrest/surrender within four weeks from the date of receipt of this order to the concerned court, let the petitioner, namely, Arun Ram be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like

Patna High Court Cr.Misc. No.6596 of 2017 (2) dt.10-02-2017 2/2 amount to the satisfaction of Chief Judicial Magistrate, Vaishali at Hajipur, in connection with Vaishali P.S. Case No. 314 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
